(a) All vending on City streets, sidewalks, parking lots, and other City property shall be conducted only in areas designated by the City of Upper Sandusky. Exhibit "A" shows the designated areas to be used by Vendors in the downtown area. Exhibit "B" shows the designated areas to be used by Vendors for "Special Events" in the downtown area. No vending shall take place outside of the designated areas located in Exhibit "A" or Exhibit "B" except as otherwise provided in this Section. All designated areas shall be located at least one hundred (100) feet from brick-and-mortar restaurants.
(b) Mobile food vendor locations designated by Exhibit "A" will be available by reservation only. Reservations will be made on a first-come-first-serve basis. Vendors may contact the Mayor's Office to schedule a reservation.
(c) Vending may only be conducted at the locations designated by Exhibit "A" every Monday through Thursday, during the months of February through November, from the hours of 5:00 p.m. to 12:00 a.m. Vendors are prohibited from setting up in the designated areas prior to 5:00 p.m.
(d) Downtown Special Event vendor locations are described in Exhibit "B". All Special Events, including those taking place outside of the areas located in Exhibit "B" will be designated by the Safety Committee and are at the Safety Committee's discretion. The time frame Vendors can conduct business during Special Events are also at the discretion of the Safety Committee.
(e) No vending shall take place in City Parks without approval from the Park Board. In the event the Park Board provides approval, the Park Board has the discretion to determine the location and time frame a Vendor may conduct business in the City Park.
(f) Brick-and-mortar restaurants in the downtown area may conduct vending without obtaining a license, as described in Section 721.01 of this Chapter, on any on-street parking directly adjacent to their building on Monday through Thursdays, during the months of February through November, from the hours of 5:00 p.m. to 12:00 a.m. and all Special Events, for the duration of the Special Event.
(g) Mobile food vending on City property in the areas located outside of Exhibit "A", Exhibit B", all Special Events, on-street parking directly adjacent to brick-and-mortar restaurants, and the City Park may only be conducted between the hours of 9:00 a.m. and 10:00 p.m. and for the sole purposes of being associated with an auction or operation of a mobile food vehicle. (A mobile food vehicle is one that stops, stands, or parks within the public right-of-way for only fifteen (15) consecutive minutes or less).
(h) No vending equipment or vehicle shall be left unattended at any time during vending hours. Vending equipment or vehicles must be removed once the vendor has ceased operation. The City may immediately remove and impound any vending equipment or vehicles left unattended which shall be treated as an illegally parked vehicle pursuant to Upper Sandusky City Code.
(i) Each mobile food vendor during the period of vending shall provide adequate trash receptacles for its customers and keep the area with twenty (20) feet of its vending location free from all litter and debris arising from its operations, including the litter which arises from actions of customers disposing of wrapping or packaging materials on products sold by the vendor. All trash must be removed from City property prior to vendor leaving.
(j) Vendors shall always exercise reasonable care that products, packaging material, display equipment, signs and other paraphernalia shall not create a safety or health hazard to customers or other persons using the sidewalks, streets, and public property.
(k) Vendors shall serve towards the sidewalk and away from the roadway except for designated Special Events wherein the street is closed to automobile traffic.
