1138.02 DEFINITIONS.
   (a)   “Applicant” means the person or entity filing an application under this Chapter.
   (b)   “Building” means a residence, school, hospital, church, public library or other structure used for public gathering.
   (c)   “Wind system owner” means a person or entity having an equity interest in a wind energy system.
   (d)   “Fall Zone” means an area surrounding the wind turbine unit into which the turbine, tower and/or turbine components might fall due to inclement weather, poor maintenance, faulty construction methods, or any other condition causing turbine failure. “Fall zone” means the area measured by using 110% of the turbine height as the radius and the tower foundation as the center.
   (e)   "Hub height" means the distance measured from the surface of the tower foundation to the center of the turbine hub.
   (f)    "Operator" means the entity responsible for the day-to-day operation and maintenance of the wind energy system.
   (g)    "Shadow flicker" means the shadow that occurs when the blades of the turbine rotor cast shadows that move across the ground and nearby structures.
   (h)    "Turbine height" means the distance measured from the existing grade to the highest point of the turbine rotor plane.
   (i)    "Wind turbine" means a wind energy system that converts wind energy into electricity using a wind turbine generator, and which includes the nacelle, rotor, tower, and pad transformer, if any.
   (g)   "Wind energy system" means a system that converts the kinetic energy of the wind into electricity available for use beyond that used by the system.
   (k)    "Non-participating landowner" means any landowner except those on whose property all or a portion of a wind energy system is located pursuant to an agreement with the system owner or operator.
   (l)    "Zoning Inspector" means the City of Upper Sandusky Zoning Inspector.
   (m)    "City" means City of Upper Sandusky, Ohio.
