1123.03 SIMILAR USES.
    (a)    Any other use not listed in Sections 1123.01 and 1123.02 are prohibited unless such use is determined to be a similar use.
   (b)    If a use is found to be similar to other conforming uses permitted in this chapter, that determination is considered as an expansion of the permitted uses and not as a variance. All similar uses will be included in the list of permitted uses in this chapter.
 
   (c)    If a proposed building or use is not specifically permitted, the application shall be submitted to the Planning Commission in compliance with the following standards:
      (1)   The use is not listed in any other classification of permitted uses;
       (2)    The use conforms to the basic characteristics of the classification to which it is to be added more than any other classification;
      (3)    The use does not create dangers to health and safety to an extent greater than normally resulting from other uses listed in the classification to which it is to be added;
      (4)    The use does not create traffic to a greater extent that the other uses listed in the classification to which list it is to be added;
      (5)    The use conforms to the intent of both the Development Plan and the Zoning Code.
   (d)    If any proposed site plan requires a similar use determination, no zoning permit may be issued unless the similar use is confirmed by the Planning Commission.
