§ A261-69. Other plans.

Notwithstanding the limitations set forth in the other provisions of §§ A261-62 through § A261-75, the benefits payable under this pension plan with respect to a member shall be deemed not to exceed the limitations of §§ A261-62 through A261-75 if:

   A.   The benefits payable with respect to such member under this pension plan and all other defined benefit plans maintained by the township do not exceed $10,000 for the plan year or for any prior plan year; and

   B.   The township has not maintained a defined contribution plan in which the member participated.
