§ A261-49.   Military service.
   A.   Subject to Subsection B, a member who has been employed by the township as a police officer for at least six months, and who thereafter enters into the military service of the United States, shall be credited with years of service equal to the period of time that the member spent in such military service, provided the member returns to his or her employment with the township as a police officer within six months after his separation from military service.
   B.   A member shall only be credited with years of service for intervening military service if he is not entitled to receive retirement benefits for such military service under a retirement system administered and wholly or partially paid for by any other governmental agency.
   C.   Subsection B shall not apply where a member is eligible to receive or is receiving military retirement benefits earned by a combination of active duty and nonactive duty with a reserve or national guard component of the armed forces.
