§ A261-39.   Preretirement survivor’s benefit.
The survivor of a member who, on the day of his death, was employed by the township as a police officer and satisfied the eligibility requirements for a normal retirement benefit as described in § A261-31 shall be eligible for a preretirement survivor’s benefit.
   A.   Survivor. “Survivor” means:
      (1)   The surviving spouse of a member; or
      (2)   If no surviving spouse, the surviving minor children of a member.
   B.   Amount. The preretirement survivor’s benefit shall be equal to the benefit such survivor would have received if the member:
      (1)   Had terminated his employment prior to his death;
      (2)   Had elected to receive a fifty-percent joint and survivor benefit as described in § A261-37B(2); and
      (3)   Had died the following day.
   C.   Duration. The preretirement survivor’s benefit shall be a monthly benefit commencing on the first day of the month following the month in which the member died, and terminating as follows:
      (1)   As of the date the surviving spouse remarries or dies; or
      (2)   If applicable, when the last of the surviving minor children obtains age 18 or dies, whichever event shall occur first.
