§ 218-4.   Barrier required.

No person or persons shall construct or maintain a bathing, swimming place or swimming pool, spa, hot tub, artificial body of water, or any excavation in which water may collect in excess of two feet, including a stormwater management structure within 300 feet of any property line of the property on which the stormwater management structure is located, unless it is surrounded by a barrier as specified by the requirements of Chapter 73, Building Construction – Uniform Construction Code, with the exception that the sides of an aboveground pool structure may not be used as a barrier; however, barriers may be placed on top of aboveground pool structures to comply with the barrier requirements. Barriers may not be less than four feet nor more than six feet in height.
