§ 212-47.   Plan processing procedures.

For approval of a or , all shall comply with the following processing procedure:
   A.   All filed for approval shall be submitted, with the appropriate application and fee as provided in the Township fee schedule 31 in the following order: [Amended 1-10-1995 by Ord. No. 879; 6-14-2011 by Ord. No. 11-1240]
      (1)    (optional but encouraged).
      (2)    .
      (3)    .
   B.   The Township Manager or his designee shall have seven days from the date of submission of an application to check the and documents to determine if on their face they are in proper form and contain all information required by this chapter. If defective, the application and fees may be returned to the with a statement of rejection, within the seven-day period; otherwise, it shall be deemed accepted for filing as of the date of submission. Acceptance for filing shall not, however, constitute a waiver of any deficiencies or irregularities. The may appeal a decision by the Township Manager under this section to the Board of Commissioners. [Amended 6-14-2011 by Ord. No. 11-1240]
   C.   Each revision, whether to a tentative, or , shall be filed one at a time. The filing of a revision shall constitute a withdrawal of the preceding version of that .
      (1)   The Township Manager or his designee shall have seven days from the date of submission to examine amended or corrected applications to determine whether such amended or corrected applications result in a substantial amendment to the or in the filing of a so changed as to be considered a new .

   D.   When a preliminary or final or is amended or revised in any respect after the original submission date, before the amended or revised is accepted by the Township Manager, the or shall execute a statement indicating that the original is amended or revised and that the time for review is extended 90 days following the next regularly scheduled meeting of the or, if that meeting is more than 30 days following the filing of the revised , then 90 days following the 30th day after filing. If the refuses to extend the time for processing, the Board of Commissioners shall at its next public meeting deny the original application. [Amended 1-10-1995 by Ord. No. 879; 6-14-2011 by Ord.    E.   When the decision reached concerning an application for approval of a specific results in a denial of the , then the , when and if he should reapply requesting approval of the , shall do so in accordance with the sequence outlined in Subsection A herein and the additional procedures below.    F.   Applications for approval of a or shall be filed with the Township Code Enforcement Office. Any application for approval of a or must include payment of the required fee, comply with the and checklist requirements, 32  and include complete copies in a paper and .pdf format of all materials filed.    G.   The , or his , shall be required to appear in person at the Township in order to make application for approval of a . [Amended 6-14-2011 by Ord. No. 11-1240]
   H.   Schedule of processing steps. The following number of copies of each shall be submitted with the application to the Township:

   I.   The date shall be stamped on each copy received. [Amended 1-10-1995 by Ord. No. 87933; 6-14-2011 by Ord. No. 11-1240]
   J.   Prior to approval, the shall provide evidence of a formal review and response from the following agencies, if applicable: [Amended 6-14-2011 by Ord. No. 11-1240]
      (1)   Highway occupancy permit (state, county or Township). 34
      (2)   Pennsylvania Department of Environmental Protection, approval for:
         (a)   Planning module for .
         (b)   Water quality management permit.
         (c)   Stream encroachment permit.
         (d)   General permits.
         (e)   Others.

      (3)   Montgomery County Conservation District for:
         (a)   Soil and sediment control.
      (4)   Appropriate Water Authority for:
         (a)   Water source.
         (b)   Extension.
         (c)   Connections.
   K.    Review. [Amended 1-10-1995 by Ord. No. 879; 10-14-1997 by Ord. No. 954; 11-14- 2006 by Ord. No. 1175; 6-14-2011 by Ord. No. 11-1240]
      (1)   The Township , the , and the Montgomery County Planning Commission shall review the and shall submit their comments and recommendations to the Board of Commissioners. Where the property is listed on the Upper Dublin Historic Inventory, the Historical Commission shall also review the and shall submit their comments. 35  Where applicable, the Environmental Protection Advisory Board will also submit its comments.       (2)   The Board of Commissioners shall act on a or within 90 days following the next regularly scheduled meeting of the Board of Commissioners next following the date the application is filed or, if that meeting is more than 30 days following the filing of the application, then 90 days following the 30th day after filing.
         (a)   The Commissioners Planning Committee will comment on a   and advise the . No formal action will be taken by the on a   application.
         (b)   If the approves a or , the Township Manager or Secretary will so certify thereon. Two copies of the approved will be returned to the .
         (c)   If the conditionally approves a , the shall subsequently submit a revised which complies with the conditions stipulated. At the time of the conditional approval, the must agree, in writing, to acceptance of the conditions specified.
         (d)   If the disapproves the , the Township Manager or Secretary will notify the , in writing, of the defects in the application stating the requirements not met.
      (3)   A point by point response letter addressing each review comment shall be provided with all resubmissions. [Added 6-14-2011 by Ord. No. 11-1240]
   L.   The , complying with all applicable requirements, shall be filed with the Township for approval within 12 months from the date of the approval of the . Failure to comply with the time limitation herein provided shall make the approval of the null and void unless an extension of time is granted in accordance with this section. The 12-month period may be extended by the Board of Commissioners upon application by the filed in writing no less than 30 days prior to the end of the twelve-month period, if all of the following is demonstrated: [Amended 2-10-2004 by Ord.       (1)   That one or more conditions existent at the time of approval have changed.
      (2)   That such change of circumstances was beyond the control and has prevented submission of the within the twelve-month period.
      (3)   That such circumstances have been overcome or will be overcome in the foreseeable future.
   M.   The will not be formally approved by the Board of Commissioners unless the required have been constructed and/or installed in strict accordance with Township and specifications, or the Township is assured by means of a proper completion guaranty in the form of a bond, or the deposit of funds or securities in escrow, sufficient to cover the cost of the as estimated by the Township , so that the will subsequently be installed.
