§ 168-2.   Rules and regulations.

The following rules and regulations are set forth for the use of the parklands in the Township of Upper Dublin:
   A.   No person or persons without a special permit shall be allowed in the parklands except between the hours of sunrise and sunset.
   B.   Persons shall enter and leave a park by the entrance and exits provided for that purpose.
   C.   No vehicle shall be used or parked in any roadway or section of the parklands except in areas designated for such purposes. No person may operate any recreational vehicle within any township park. “Recreational vehicle” shall mean any hot-air balloon, mini-bike, dirt bike, all-terrain vehicle (ATV), off-road vehicle (ORV) or other form of motorcycles or any snowmobiles.    D.   The washing or repair of any motor vehicle shall not be permitted.
   E.   Intoxicating beverages shall not be sold or distributed or consumed except under special permit in certain designated park areas.
   F.   Intoxicated persons shall not be permitted in a park.
   G.   Gambling or any obscene or indecent act shall not be permitted.
   H.   Abusive, indecent or threatening language or any conduct that may annoy shall not be permitted.
   I.   No device that expels a projectile may be used in a manner which threatens or tends to threaten the safety of any person. The promiscuous use of javelins, arrows, discuses or similar athletic equipment dangerous in character is prohibited unless used under the direct supervision of an authorized playground supervisor. No firecrackers, fireworks or rockets are permitted except with adequate supervision and with a special permit. [Amended 11-10-2009 by Ord. No. 09-1223; 7-14-2015 by Ord. No. 15-1305]
   J.   No person or persons shall in any way injure, foul, pollute or deface any building, equipment, signs and standards or water.
   K.   No person or persons shall cut, remove, injure or destroy flowers, plants, wildflowers, shrubbery or trees. This includes downed trees cut up for firewood. No person or persons shall erect any structures or install plant material on parkland or assume parkland for personal use. [Amended 1-10-1995 by Ord. No. 879]
   L.   Pet animals, including but not limited to dogs, cats and horses, shall not be permitted except in designated areas. [Amended 1-10-1995 by Ord. No. 879]
   M.   No person shall scatter or drop or leave litter except in receptacles provided for that purpose. No dumping of household, construction, commercial or landscape debris in receptacles or on parkland for removal by the township is permitted. [Amended 1-10-1995 by Ord. No. 879; 9-9-1997 by Ord.    N.   No person shall deface or destroy any notices, rules or regulations for the regulation of a park system posted or in any manner permanently fixed within the limits of the same.
   O.   No person shall annoy, strike, injure, maim or kill any animals or birds.
   P.   Fires shall only be allowed in designated areas where fireplaces, stoves or grills are provided by the township. Fires must be completely extinguished before leaving a site. [Amended 1-10-1995 by Ord. No. 879]
   Q.   Scheduling and permits. [Amended 1-10-1995 by Ord. No. 879; 8-14-2001 by Ord. No. 1067]
      (1)   Any individual or group of individuals desiring the privilege of having the exclusive or special use of all or portions of any park area, ground, building, athletic field or other recreational facility shall schedule such use with and obtain a permit from the township. Individuals or groups desiring to conduct organized activities on park grounds shall schedule such activities with and obtain a permit from the township.
      (2)   Scheduling and permit application shall be made with the Parks and Recreation Department at least two business days before the date of the desired use. Established fees, security deposits and/or required certificates must be paid and/or filed with the Parks and Recreation Department at the time the permit application is submitted for approval and scheduling.
      (3)   Any individual or group of individuals using a park facility to the exclusion of others without a permit shall remove themselves from the facility upon request by a properly scheduled and permitted user or authorized township official or staff member.
      (4)   No permit will be issued for a use that violates Township regulations regarding the use of park facilities. The Township reserves the right to revoke any permit if those using the park pursuant to the permit violate Township regulations. The Township further reserves the right to limit the number of permits issued if the capacity of the facilities is exceeded.
      (5)   These regulations do not apply to minor children engaged in ordinary and customary play, except that children must remove themselves from a park facility upon request by a properly scheduled and permitted user or authorized Township official or staff member.
   R.   When possible, Township residents shall be charged lesser fees than nonresidents for the use of park facilities and for participation in recreation programs. [Amended 1-10-1995 by Ord. No. 879]
   S.   Activities and games.
      (1)   Activities and games shall only take place in areas designated for such. Individuals or groups using parklands, with or without Township permission, are responsible for any damage done to turf or equipment. [Amended 1-10-1995 by Ord. No. 879]
      (2)   No person shall use parkland for the purpose of a golf driving or practice range. [Added 9-9-1997 by Ord. No. 949]
   T.   There shall be no swimming, ice skating, fishing, boating, snorkeling or scuba diving by any person at any time except in those areas so designated for these purposes.
   U.   Soliciting prohibited.
      (1)   There shall be no soliciting of any kind, including the sale or vending of food, on parklands or at Township recreational programs except by permit issued by the Township. [Amended 1-10-1995 by Ord. No. 879]
      (2)   Use of any park facility or section of a park facility for commercial or profit-making activities without a special permit issued by the Township is prohibited. [Added 9-9- 1997 by Ord. No. 949]
   V.   Camping shall be permitted only in certain designated areas and only by special permit issued by the Department. [Added 1-10-1995 by Ord. No. 879]
   W.   All public parks and recreational areas including, but not limited to, fields, tennis and basketball courts, trails and pavilions shall be used only for their intended purpose and no other unless a special permit has been issued by the Township. [Added 9-9-1997 by Ord. No. 949]
   X.   Smoking. “Smoking” is defined as the carrying by a person of a lighted cigar, cigarette, pipe or other lighted smoking device. In accordance with § 158-15, smoking is prohibited within, on, or throughout all properties managed, maintained and regulated by the Township, including, but not limited to, parks, playgrounds, playing courts, athletic fields and open space, and all buildings and structures within parks and playgrounds.    Y.   It is prohibited to operate a motor vehicle in any Township park at a rate of speed greater than 15 mph. [Added 3-12-2013 by Ord. No. 13-1269]
