(A) The Council finds and determines that a need exists for the financing of economic development facilities and pollution control facilities, as defined in I.C. 36-7-12.
(B) The Town Department of Development is established. The Department shall be under the control of the town’s Economic Development Commission. The Commission shall consist of three members as provided in I.C. 36-7-12-6.
(C) The Department of Development and the town’s Economic Development Commission shall be organized, the members appointed and qualified and exercise the functions and have all of the powers and duties authorized by I.C. 36-7-12.
