1640.05 TYPES OF DETECTORS; TESTING.
   Battery operated smoke detectors may be used only in existing structures. The batteries must be replaced at least once a year or as recommended by the manufacturer of the detector. All batteries must bear a tag showing the date installed. Each detector shall be tested with smoke at the time the batteries are replaced. Any detector found to be inoperable shall be repaired or replaced immediately. In all new construction, detectors shall be permanently wired and powered by 115-volt electrical circuit and shall be tested with smoke at least once each year. The owner is responsible for maintaining a record of such tests.
