1620.04 STATEMENTS OF COMPLIANCE.
   (a)   Duty of Installing Contractor. Prior to the issuance of an occupancy permit, in addition to any requirements of the Building Department, the installing contractor shall submit a Statement of Compliance Form to the Fire Department, specific to the fire protection system installed, requesting that the Fire Department witness an acceptance test(s). Such Statement of Compliance must be submitted to the Fire Department a minimum of 48 hours prior to the acceptance test.
   (b)   Statement of Compliance Form. A Statement of Compliance Form specific to each fire protection system may be obtained from the Fire Department. Such forms shall include the following language:
      (1)   Statements that inform the Fire Department that the installation, inspection and successful testing of the fire prevention system was completed by the installing contractor;
      (2)   The text of Ohio Fire Code Section 901.2.1 entitled “Statement of Compliance” or equivalent amended requirements; and
      (3)   A statement notifying the installing contractor of the penalties, contained in division (c) of this section, of submitting a Statement of Compliance Form that contains erroneous or false information as evidenced by a failed acceptance test as performed by the Fire Department or that does not contain an attachment outlining deviations from the design standards.
   (c)   Penalties. The submission of a Statement of Compliance Form, as required by this section prior to the issuance of an occupancy permit, that contains an erroneous or false statement as evidenced by a failed acceptance test as performed by the Fire Department or does not contain an attachment outlining deviations from the design standards shall result in the following fines to the installing contractor:
      (1)   Two hundred fifty dollars ($250.00) for the first violation of this section at a subject property;
      (2)   Five hundred dollars ($500.00) for each subsequent violation of this section at a subject property.
   (d)   Each time an installing contractor is fined for violation of this section, a new Statement of Compliance Form must be submitted to the Fire Department a minimum of 48 hours prior to the retest. The Fire Department will not witness any retest until such time as all fines levied pursuant to this section have been submitted to the City.
