1496.07 FEES; CHANGES IN BUSINESS OCCUPANCY.
   (a)   An application for a certificate of business occupancy shall be accompanied by a nonrefundable fee, as follows:
      (1)   Retail usage. A fee of $0.02 per square foot of space usable for such purpose or related incidental purposes, subject to a minimum fee of $25.00 for each retail unit and a maximum fee of $1,000 for each retail unit. In the event of dispute over the application of minimum and maximum fees, it shall be the responsibility of the owner to provide the City with such documentation as is reasonably necessary to determine the application of minimums and maximums.
      (2)   Office usage. A fee of $0.01 per square foot of space usable for such purpose and related incidental purposes. Minimum fee, $25.00; maximum fee, $500.00.
      (3)   Gas stations and auto repair garages. A fixed fee of $125.00.
      (4)   Warehouse or indoor storage space. A fee of $0.02 per square foot of space usable for such purpose and related incidental purposes. Minimum fee, $25.00; maximum fee, $500.00.
      (5)   All other uses. A fee of $0.02 per square foot of space usable for such purpose and related incidental purposes. Minimum fee, 25.00; maximum fee, $500.00.
   (b)   Multiple Occupancy. When a building is occupied by more than one retail unit, the owner of the building shall make application for a certificate of business occupancy for each such unit and shall pay the fee therefor, except that:
      (1)   The owner may, by contract with his or her tenants, by lease, or otherwise, require the certificate fee and costs of compliance with this Commercial Structures Maintenance Code to be reimbursed to him or her by any or all of the tenants; and
      (2)   No tenant shall be precluded from filing an application required of the owner of his or her building.
   (c)   Changes; New Certificate of Business Occupancy; Fees. If there is a change in the business occupancy or authorized use covered by any certificate of business occupancy, such certificate shall automatically become null and void. Application for a new certificate shall be made within ten days after such change in occupancy or use, along with a fee of $10.00. A new certificate, when issued, shall expire on the same date as the certificate applicable to the former occupancy or usage, except that the new applicant may request and receive a certificate expiring one year from the date of issue or the date on which such certificate was required, whichever occurs first, upon payment of a full annual fee, in lieu of the $10.00 replacement fee.
