(a) The Building Commissioner shall, as soon as practicable after the effective date of this Commercial Structures Maintenance Code, institute a program of systematic area-wide inspection of all property subject to the Code, and shall repeat such inspections on a periodic basis in order to maintain an ongoing program reasonably calculated to assure the purposes of this Code.
(b) Upon filing of an initial application for a certificate of business occupancy, the owner or tenant of a building requiring a certificate of June 1,1974, shall be deemed to be in compliance with the requirements of Section 1496.01 until such time as the Commissioner either issues a certificate of business occupancy or denies issuance based on an invalid or improper application or based on an inspection and subsequent failure by the occupant, owner, agent or operator to comply with this Code.
