(a) Any person engaged in the business of generating or releasing any noxious or poisonous fumes or gases in any building, or part thereof, for the purpose of exterminating therein insects or any vermin shall, while such fumes or gases are being generated or released and while they remain within such building, or any part thereof, in such density or other condition as to endanger life or as to be injurious to any person, cause warning signs to be posted conspicuously upon such building, and in addition shall cause to be stationed at such building such number of persons as are sufficient to observe and warn any person about to enter such building or part of the building of the dangerous condition therein, and such persons stationed at such building shall prevent the entry of any person until all danger from such fumes or gases has ceased.
(b) Before the generation or releasing of such fumes or gases, the person in charge or control of the generating or releasing thereof shall make careful inquiry and examination of every room or part of the building in which gases or fumes are to be released or generated. If he or she finds any person in any room or part of the building, he or she shall advise such person of the work to be done and of the danger attended upon remaining in such building. He or she shall not generate or release such gases or fumes until the
person so advised of his or her intent to do so has left the building and until he or she is satisfied from thorough examination and investigation that no person remains in the building or any part thereof.
