1458.01 PERMIT; REQUIREMENTS.
   Anything to the contrary in these Codified Ordinances notwithstanding, the Building Commissioner is authorized to issue a permit after proper application for the installation of a hardsurface, dust-free patio in the rear yard of any single family or two-family residence in the City. In addition to complying with all of the other applicable laws, ordinances and regulations pertaining thereto, such patio must also meet the following requirements:
   (a)   The maximum area shall be 3% of the total lot size, but in no event more than 300 square feet.
   (b)   (1)   No part of the pavement shall be constructed within three feet of a driveway or other facility for the parking of automobiles; or
      (2)   That part of the pavement to be constructed which does not otherwise qualify under (b)(1) immediately above, shall be separated from the nearest driveway or other facility of not less than ten inches.
   (c)   No part of the pavement shall be constructed within three feet of any property line.
