The following regulations shall be observed as to fences in residential districts:
(a) No person shall construct or maintain or permit any fence or other structure or any bushes or other plants or trees on a corner which obstructs the view so as to interfere with traffic visibility, either on a curve or at an intersection.
(b) A rear yard or portion of rear yards may be enclosed by fences not over six feet high above grade. No fence shall be permitted to be closer to the front property line than the rear foundation line of the main building, except, where there is no rear door on the existing dwelling, fences and gates may be placed up to one foot forward of a side door along driveways.
(c) On a corner lot no fence shall be closer to the sidewalk than the side of the house toward the side street. However, fences not exceeding five feet in height above finish grade may be located no closer than three feet from the public sidewalk nor farther forward than the rear foundation line of the house, when and if the Building Commissioner determines that such installation will not create a hazard to vehicular or pedestrian traffic. Such fence shall be at least 25% open to permit visibility.
(d) The Building Commission may permit the following fences, providing that the proposed fence will not, in his or her opinion, adversely affect adjoining or neighboring property:
Fences not over six feet high above grade, in side yards extending not farther forward than the front setback line and any return of such fence to a building shall be provided with screen planting to substantially screen the fence from street view.
(e) On appeal from a decision of the Building Commissioner, the Board of Zoning Appeals may permit variances from these regulations in cases where exceptional physical conditions exist or the established regulations or standards of this chapter are inappropriate or inapplicable and the requested variances will not adversely affect adjoining property.
