852.02 SOLICITATIONS TO SELL RESTRICTED.
   (a)   No real estate broker, real estate salesman or other person shall telephone, personally call upon, mail or hand deliver literature to a resident-owner of a single or two-family dwelling unit in this City for the purpose of securing a listing for sale of real estate, or for any purpose relating to the sale of such owner's property when such homeowner has indicated a desire not to be so solicited pursuant to the provisions of this section.
   (b)   The prohibition of division (a) hereof, applies with respect to any single or two-family homeowner who signs and submits to the Community Coordinator a written form listing the address of the home so owned, specifically stating that the owner does not wish to sell his home or does not wish to be contacted in person, by telephone, by mail or by hand delivered literature for the purposes set forth in or by the persons described in this section.
   (c)   Each notice submitted will be placed on file as a public record by the Community Coordinator at the city hall. The Clerk shall maintain an up-to-date list of the homeowners and their addresses as submitted. Such list and records shall be available to the public during the regular business hours of city hall.
   (d)   The prohibition of division (a) hereof, shall cease to apply only upon submission to the Community Coordinator of a signed, written request by a homeowner who has previously given the notice provided in division (b) hereof for the removal of his or her name from the appropriate record; or upon the advertisement for sale by an owner of the premises on which solicitation has been prohibited under this section.
   (e)   Notwithstanding any penalty provided for under the terms of this chapter the Director of Law or any resident of the City, or any other person, firm, corporation, partnership or other entity may commence a civil action in any court of competent jurisdiction against any person firm, corporation, partnership or other entity who violates the provisions of this section. Such relief includes any permanent or preliminary injunction and such other relief as the Court may deem appropriate, including but not limited to reasonable attorneys' fees and expenses and Court costs.
   (f)   In the event of a violation of the provisions of this section by telephone and/or mail originated from outside the limits of the City and directed to a resident there will be venue in the City.
   (g)   The Community Coordinator is hereby authorized and directed to place on file as a public record each notice received pursuant to this section and to compile a list of homeowners and addresses of the homes so owned.
   (h)   If any provisions of this section is held invalid, the remaining provisions shall not be affected thereby.
