808.05 FALSE ALARMS AND UNSATISFACTORY MAINTENANCE.
   (a)   No person shall fail to maintain equipment under his control designed to give alarms of any type at less than the level of maintenance necessary to prevent false alarms from being emitted.
   (b)   It shall be prima facie evidence of unsatisfactory maintenance in violation of division (a) hereof if:
      (1)   Two alarms are emitted and reported in any manner to the Division of Police ro Fire for which no external cause can be found, if such alarms occur within six months of each other; or

      (2)   If an alarm fails to deactivate within five minutes of the first noise emitted by the alarm, or if one alarm is emitted and reported in any manner to the Division of Police or Fire for which no external cause can be found.
   (c)   Warning Notice.
      (1)   Upon a finding of probable cause that a violation has occurred as governed by division (a) and/or (b) hereof, the Chief of Police shall issue a warning notice by letter, which shall be valid and in effect for six months from the date of issuance, upon or to the owner, tenant, occupant or other person in possession of the premises at or upon which the alarm is located.
      (2)   Such warning notice shall warn and notify such person that any additional alarms within six months of the issuance thereof will subject the person so notified, including the owner, tenant, occupant or other person in possession of the premises at or upon which the alarm is located, to a fine as provided in division (d) hereof.
   (d)   A fine of $50.00 for a first violation of division (a), which fine shall be waiverable, a fine of $50.00 for a second violation, and $100.00 for each subsequent offense shall be imposed.

   (e)   No offense shall be charged under this section for a false alarm to which there is no response by the Division of Fire or Police, nor when the cause has been proven to be an act of God.
