(a) No person shall use any street or sidewalk area, including the lateral strip area between the street and sidewalk, for the display or sale of merchandise or for any advertising display.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree for a first offense; a misdemeanor of the third degree for a second offense; and a misdemeanor of the second degree for a third or subsequent offense.
