236.06 AUXILIARY POLICE UNIT.
   (a)   Established. There is hereby established within the Department of Public Safety an Auxiliary Police Unit, pursuant to Ohio R.C. 737.051. Members shall be appointed by the Director of Public Safety, with the approval of the Mayor.
   (b)   Term of Service. Auxiliary police officers shall serve so long as the Director may direct, or until a resignation submitted by such members shall be accepted by the Director.
   (c)   Qualifications of Members. The members of the Auxiliary Police Unit shall be residents of the City or be employed by a corporation or organization located within the boundaries of the City, including City employees and may not be under the age of 21 and shall meet such other requirements as are provided by ordinance or by the rules and regulations prescribed by the Director. In addition, any member who moves out of the City may continue to serve as a member of the Auxiliary Unit as long as they have completed at least three years of service with the unit.
   (d)   Control of Units. The Director shall be the executive officer of the Auxiliary Police Unit. The Chief of Police shall be the commanding officer and shall have control of the assignment, training, stationing and the direction of work. The Auxiliary Police Unit shall have only such police powers and shall perform only such police duties as assigned by the Chief of Police, and shall act only when in prescribed uniforms or portion of uniform. The Chief of Police shall prescribe the time and place such uniforms or portions thereof shall be worn. Auxiliary members shall obey the chain of command of the Division of Police and shall take orders from all regular appointed members thereof. They shall bear firearms only when on active duty and on special direction of the Chief of Police and provided that they have completed the police training in compliance with Ohio R. C. 109.77. "Active duty" means assignment under proper authority and while actively engaged in police or civil defense duties.
   (e)   Rules and Regulations. EDITOR'S NOTE: The Rules and Regulations of the Auxiliary Police Unit are not codified. Ordinance 93-11, passed March 1, 1993, amended such Rules and Regulations. Copies of the Rules and Regulations and all amendments thereof may be obtained, at cost, from the Clerk of Council.
   (g)   Service on Voluntary Basis.
      (1)   All services performed by auxiliary police officers shall be on a voluntary basis and within the City.
      (2)   Auxiliary police officers shall not be compensated for their services.
      (3)   Auxiliary police officers shall not be entitled to any benefits of any relief and pension funds of the City or the State of Ohio, nor shall they be in the classified service of the City. They shall, however, be covered by Worker's Compensation as provided by Ohio R.C. 4123.03.
   (h)   Non-liability. This section is declared by Council as an exercise by the City of its police powers for the protection of the public peace, health, property, safety and general welfare, and neither the City, nor agent or representative of the City, or any individual, firm, partnership or corporation who in good faith executes any executive order, rule or regulation promulgated hereunder, shall be liable for injury or damage sustained by or to any person or property as the direct proximate result of such action. In addition to any other responsibilities or immunities the members of the Auxiliary Police Unit shall bear the same responsibilities and immunities as any regularly employed member of the Division of Police of the City; except as herein provided.
   (i)   Use of City Assets. For the purposes of establishing training and maintaining the Auxiliary Police Unit, the Director of Public Safety may utilize services, equipment, supplies and facilities of existing departments of the City, and the funds appropriated by Council for civil defense or otherwise appropriated by Council.
