§ 31.38 CITY ATTORNEY.
   (A)   The city hereby establishes the position of the City Attorney and shall from time to time retain a person for such services and for such periods of time as it deems necessary.
   (B)   The City Attorney shall attend all regular meetings of the City Commission, shall advise the Commission in all legal proceedings, legal matters, or matters of litigation, shall possess all the necessary powers and authority to carry out the functions of this office as conferred on the City Attorney by law, and shall perform all other duties as required by the Commission.
   (C)   Compensation for the City Attorney shall be in the amount as established by the City Commission by resolution.
   (D)   The City Attorney shall be employed as an independent contractor.
