(A) Under IC 36-7-2-3, which addresses the power of a city to inspect a structure, the Enforcement Officer is authorized to enter any premises within the municipality during reasonable hours, with reasonable notice to the owner and occupant, in order to make any inspection necessary to investigate complaints and to enforce the provisions of this subchapter. If the owner or occupant cannot be located, the notice may be posted on the building in question, advising the owner or occupant to contact the Enforcement Officer for purpose of the gaining entrance for inspection purposes and that, if the owner or occupant does not contact the Enforcement Officer within three days, then the Enforcement Officer will enter the property to do the inspection without further notice.
(B) The Enforcement Officer shall have the authority to employ any expert necessary to evaluate the risk in any potential violation of this subchapter, on the condition that the employment of an expert is approved by the Mayor or City Manager, if the reasonably anticipated cost of the employment of that expert is under $500. If the reasonably anticipated cost of the employment of that expert exceeds $500, then the employment of the expert shall be approved by the City Council.
