§ 113.01 HOME SALE REGULATIONS.
   (A)   No person shall conduct a home sale at any residence in the city, without first obtaining a permit authorizing the home sale from the city Clerk-Treasurer.
   (B)   No person, who has obtained such a permit, shall violate any rule or regulation provided for in any part of this chapter.
   (C)   No home sale shall be conducted by the same resident or a member of that resident's family on the same residential property for more than six days in any one year. For purposes of this division, home sales conducted during the annual City Wide Garage Sale will not be deducted from the six days allowed an individual resident for home sales in a year and will not require a permit.
   (D)   In the event that a home sale could not take place during the time authorized on a resident's permit due to inclement weather, the resident must notify the Clerk-Treasurer within 72 hours of the date established for the sale to receive credit for the day(s) that a sale could not be held.
   (E)   No home sale shall be conducted prior to 7:00 a.m. or after 8:00 p.m., official municipal time, nor shall any sale continue for more than three consecutive days.
   (F)   No resident shall post more than one sign on the sale property advertising any sale. In addition, one directional sign may be posted on a separate property with permission of the property owner. No sign shall be posted or attached to any fixture located within a municipal, county or state right-of-way, including, but not limited to, light poles, fire hydrants, speed limit signs, power poles, or telephone poles. No sign advertising a home sale shall have an area in excess of 16 square feet, be illuminated or animated. No sign advertising a home sale shall be posted at any time except during the actual home sale between the hours of 7:00 a.m. and 8:00 p.m.
   (G)   No sign advertising a home sale shall be maintained anywhere within the municipal corporation limits, except as set out in division (F) above. Any sign that is erected, denoting information necessary to find the home sale, shall be prima-facie evidence of a violation of this section.
   (H)   For purposes of the above and foregoing, the terms set out below shall have the following definitions:
      (1)   "Home Sale." Home sale means the sale of personal property to the general public conducted on any portion of a residential property within the city limits, which includes, but is not limited to, garage sales, patio sales, yard sales, porch sales, basement sales, drive-way and car-port sales.
      (2)   "Year." The period of time between January 1 and December 31 of any calendar period, as opposed to any 365 day period.
   (I)   A person who violates any provision of this chapter may be subject to a fine of not less than $25 and not more than $500.
