§ 30.23 CITY MANAGER.
   (A)   The Mayor is authorized to employ a full-time non-partisan City Manager to be the administrative head of the city government as provided by IC 36-4-12-1 et seq.
   (B)   The City Manager, so appointed, shall serve at the pleasure of the Mayor with the approval of the City Council. The City Council shall determine the City Manager's compensation and terms of employment.
   (C)   The City Manager may not be a current elected official. A former elected city official may not be employed as City Manager for a period of two years after leaving office. The Mayor and Clerk-Treasurer shall appoint a committee to consider prospective candidates for the position of City Manager on the basis of the applicant's administrative and educational qualifications. The committee shall give special deference to actual experience or knowledge of accepted practices in the field of municipal management. The City Manager shall not campaign for or against a candidate for any elected city position.
   (D)   The City Manager shall serve under the direction of the Mayor and have the following powers and duties:
      (1)   Attending the meetings of the legislative body and all other constituted city boards;
      (2)   Hiring city employees, with the approval of the Mayor, according to pay schedules and standards fixed by the City Council or by statute, with the exception of Water Department employees.
      (3)   Making recommendations to the Mayor regarding the suspension, discharge, removal or transfer of city employees, with the exception of Water Department employees.
      (4)   Administering and enforcing all ordinances, orders, and resolutions of the City Council;
      (5)   Ensuring that all statutes that are required to be administered by the City Council, Mayor or a city employee, subject to the control of the City Council or Mayor, are faithfully administered;
      (6)   Preparing budget estimates and submitting them to the legislative body when required;
      (7)   Executing contracts on behalf of the city for materials, supplies, services, or improvements after the completion of the appropriations, notice, and competitive bidding required by statute;
      (8)   Receiving service of summons on behalf of the city;
      (9)   Administering the city's economic development plans and projects;
      (10)   Advising the Mayor, the Clerk-Treasurer, the City Council, all constituted city boards and the public on the conduct of city affairs;
      (11)   Making recommendations on policy formulation;
      (12)   Recommending and executing city improvements; and
      (13)   Performing other duties and responsibilities required to carry out the spirit and intent of the above stated duties.
