§ 95.31 PENALTY FOR FAILURE TO REPAIR.
   (A)   In the event an owner fails to comply with an order to repair or replace a sidewalk issued under this subchapter without justifiable cause, then the city may repair or replace that sidewalk. The reasonable and necessary cost of that repair or replacement shall be the responsibility of and charged to the property owner.
   (B)   In the event that the property owner fails to correct the unsafe sidewalk within the time designated in the notice, or an extended time granted by the City Manager, the owner may be fined in an amount of $25 to $100 per day for each day following the expiration of the 30 day period or the extended period granted to the property owner that the unsafe condition continues.
   (C)   An unsafe sidewalk may be deemed a public nuisance. The city shall have the right to bring an action in a court of competent jurisdiction against the property owner for the abatement of that public nuisance and for all other equitable and legal relief.
