§ 39.02 PURCHASE OF SUPPLIES MANUFACTURED IN THE UNITED STATES.
   (A)   Supplies purchased by the city shall be manufactured in the United States through its Purchasing Agency unless the Purchasing Agency or a person designated by them, determines that:
      (1)   The necessary supplies are not manufactured in the United States in reasonably available quantities;
      (2)   The price of the needed supplies manufactured in the United States exceeds, by an unreasonable amount, the price of available and comparable supplies manufactured elsewhere;
      (3)   The quality of the supplies manufactured in the United States is substantially less than the quality of comparably priced available supplies manufactured elsewhere; or
      (4)   The purchase of supplies manufactured in the United States is not in the public interest.
   (B)   The Purchasing Agency or any person acting as a purchasing agent designated by the Purchasing Agency shall purchase all supplies and services required by the city from the Department of Correction, if those needed supplies and services are listed in the Department's printed catalog unless those supplies and services cannot be furnished in a timely manner, do not meet the specifications and needs of the city, or cannot be purchased at a fair market price.
   (C)   (1)   The Purchasing Agency or any person acting as a purchasing agent designated by the Purchasing Agency shall purchase articles required by the city which are produced by the State Rehabilitation Center for the Blind and Visually Impaired and are listed in the State Rehabilitation Center's current catalog, from the State Rehabilitation Center, unless those supplies and services cannot be furnished in a timely manner, do not meet the specifications and needs of the city, or cannot be purchased at a fair market price.
      (2)   Whenever the city needs an article in the catalog, the Purchasing Agent shall give the State Rehabilitation Center a reasonable time to produce or supply the article, unless that article is produced by the Department of Correction. The Purchasing Agent may purchase an article described in the current catalog elsewhere, if the State Rehabilitation Center provides a written statement that the State Rehabilitation Center cannot furnish the article in a timely manner.
   (D)   When the city needs supplies, services or articles not available through the Department of Correction or the State Rehabilitation Center for the Blind and Visually Impaired, the Purchasing Agent may purchase these supplies and services from a qualified nonprofit agency for persons with severe disabilities under the same conditions as supplies produced by the Department of Correction are purchased, when those required supplies meet the specifications and needs of the Purchasing Agent and can be purchased at a fair market price.
