Failure to abide by any of the above conditions when a UTV Side by Side vehicle is in use on city streets, or public property, shall constitute a violation of this chapter. Fines and penalties for violations of this chapter are as follows:
(A) First violation: $100;
(B) Second violation: $250 and a 60-day suspension from using UTV Side by Side vehicles on city streets;
(C) Third and subsequent violations: $500 and a lifetime suspension from using UTV Side by Side vehicles on city streets.
(D) Any conviction for criminal trespass (IC 35-43-2-2), operating while intoxicated offenses (IC 9-30-5), or reckless driving (IC 9-21-8-52), involving UTV Side by Side vehicles, as defined by IC 14-8-2-185, subsequent to the passage of this chapter, shall result in an automatic lifetime suspension from the operation of UTV Side by Side vehicles on city streets.
(E) Violation of a 60-day or lifetime suspension shall result in a $1,000 fine for each offense.
(F) Replacement cost for lost stickers shall be $25.
