In addition to the procedures for Hearings set forth in Section 159.04, the following shall apply to Hearings on Appeal from Rejection of Application and/or Conduct of Examination:
(a) The appellant shall present the evidence on which appeal is based.
(b) The Board shall hear from the Director of Personnel an explanation of the applicable rules and policies and how they were administered in the action which is subject of appeal.
(c) The Board shall hear rebuttal evidence, if offered, and a final argument by the Personnel Director (or counsel) and appellant (or counsel).
(d) In addition to the powers conferred by Section 159.04, the Board may resolve an appeal by including in its decision that an examination and/or eligible list is declared void.
