(a) Appointing Authority. The Manager shall have sole authority to make appointments to and remove persons from any position in the classified service of the City, pursuant to the Rules. Such actions may be appealed as set forth in Section 155.01(d) .
(b) Appointments in General.
(1) All appointments to the classified service of the City shall be made according to merit, to be ascertained, as far as practicable by competitive examination.
(2) The Director of Personnel shall establish and maintain eligible lists from the results of examinations. Such eligibles shall be certified to the Manager when appointment( s) is (are) anticipated. Each appointment to the classified service not made by promotion, transfer or reduction shall be made from among the top five eligibles.
(c) Recruitment.
(1) When an eligible list is to be created, the Director of Personnel, in consultation with the appropriate department director. shall establish minimum qualifications and the date. time and place of examination.
(2) The minimum qualifications and date. time and place of examination shall be advertised at least once and at least two weeks prior to the examination. Such advertisement shall be made in a newspaper or periodical of general circulation in the City and shall be posted in full public view at City Hall.
(d) Applications.
(1) An application for employment shall be considered an expression of intent to take the examination. Applications for classified positions shall be accepted only after proper advertisement is made.
(2) Such application shall be completed in the candidate's own handwriting and shall include full name, date, address, social security number. telephone number and any other information relative to bona fide occupational qualifications.
(3) Applications shall be returned to and be in the possession of the Director of Personnel, or his /her agent, by the earliest of the close of business two weeks following advertisement.
(4) Failure to meet the established qualifications shall disqualify a candidate from examination. Falsification of information on an application shall be cause to disqualify a candidate from examination or appointment for up to two years. If at any time a candidate is found to be of such character and reputation as would be cause for discharge of a classified employee, such candidate shall be removed from consideration.
(5) Matters concerning the rejection of an application or removal from consideration may be appealed to the Manager within three business days of the date of such appealable action. Further appeal is subject to Section 155.01(d).
(e) Examinations.
(1) Examinations shall be public and open to all citizens of the United States and those persons who have legally declared their intentions of becoming United States citizens, subject to these Rules.
(2) Examinations shall consist of one or more tests in any combination. Tests may be written, oral, physical, demonstration of skill, or an evaluation of training and experience and shall be designed to fairly test the relative capacity of the person to quickly learn and efficiently do the job.
(3) The passing score(s) shall be established before examination. Failure to pass one component of an examination may be deemed cause to disqualify a candidate from further competition.
(4) Matters concerning the conduct of examination may be appealed to the Manager not later than three business days following establishment of the eligible list. Further appeal is subject to Section 155.01(d).
(f) Eligible List.
(1) From the scores of the examination, the Director of Personnel shall prepare an eligible list of all candidates who attain a passing score. Such names, along with address, telephone number, and social security number, shall be listed in order of score, the highest score first and the lowest score last.
(2) Tie scores shall be settled by priority of application filing date and/or time stamp. In the event of identical filing dates, ties shall be settled by the Director of Personnel upon flip of a coin in the presence of one other official.
(3) An eligible list shall be kept for a period, to be determined by the Director of Personnel, for not less than six months nor longer than two years. As names are removed from the eligible list due to appointment, disqualification, withdrawal or refusal of appointment, the names shall be renumbered as to order of eligibility.
When less than five names remain on an eligible list, the list may be terminated.
(g) Original Appointment.
(1) When an entry level vacancy is to be filled in the classified service, the Manager shall request, and the Director of Personnel shall certify to the Manager, an appropriate eligible list. The Manager may select for appointment one of the top five candidates on the list.
(2) When there are urgent reasons for filling a vacancy in any position in the City service and there is no list of eligible persons for such position, the City Manager may appoint a person provisionally to fill such vacancy with the understanding that he/she will be required to take the competitive examination from which selection and appointment will be made. Such provisional appointment shall not continue more than ten days after an eligible list has been prepared for such position, nor in any case for a period of more than one hundred twenty days. Such provisional appointment shall count as time served towards completion of probationary period when and if a permanent appointment is achieved.
(3) Upon establishment of an appropriate eligible list, the Director of Personnel shall certify to the Manager the names of the top five candidates and the name of the provisional employee, provided such employee took and passed the examination. The Manager may then appoint either the provisional employee or from among the top five candidates.
(h) Promotional Appointments. Every classified position above the entry level shall be filled through promotional selection process, as follows:
(1) The Director of Personnel shall decide which class(es) of workers is eligible to compete for a given promotional position.
(2) Notice of a promotional examination shall be posted in the work area of such class(es) of employees for at least five continuous business days to commence not less than two weeks prior to the promotional examination.
(3) A regular non-probationary employee in such class(es) shall be eligible to compete for promotion and may apply to the Director of Personnel not later than the close of business two days prior to the examination.
(4) The promotional examination shall be conducted pursuant to applicable Rules in subsection (e) hereof, except that promotional appointment shall be made from among the top three eligibles.
(i) Reinstatement. The Manager may reinstate, without examination, a person who has resigned in good standing within the past twelve months. Reinstatement may be to a position equal to or of lesser rank than the position from which he/she resigned.
(j) Probationary Period.
(1) All original and promotional appointments shall be for a probationary period of twelve months and no appointment is deemed final until the employee has satisfactorily completed the probationary period.
(2) With approval of the Manager, the Director of the department which the employee serves may extend the employee's probationary period for not more than six months. An original appointee's failure to merit removal from probationary status after eighteen consecutive months of probation shall be terminated. A promotional appointee's failure to merit removal from probationary status after eighteen consecutive months of probation shall be returned to his/her previous position or a position of similar pay for which he/she is qualified, as soon as practicable.
(3) No appointment is deemed final until the Director of the department in which the employee serves, certifies to the Director of Personnel, in writing, that the employee's work has been found to be satisfactory and that the employee is recommended for removal from probation and into regular employment status.
