951.07 PERMIT FOR ASSEMBLIES; FEES; REVOCATION.
   (a)    Applications for a park permit shall be filed with the Clerk not less than thirty days before the date on which it is proposed to conduct any activity restricted by Section 951.06. A fee of five dollars ($5.00) shall be collected for each such permit. Such application shall be sworn to and affirmed and shall state the following:
      (1)    Name of person or organization wishing to conduct such activity.
      (2)    If the activity is proposed to be conducted for or on behalf of or by an organization, the name, address and telephone number and the headquarters of the organization and of the authorized and responsible head of the organization.
      (3)    The name, address and telephone number of the person who shall be the chairman of such activity and who will be responsible for its conduct.
      (4)    The name, address and telephone number of the person or organization to whom the permit is to be issued.
      (5)    A date when such activity is to be conducted.
      (6)    The park or portion thereof for which the permit is desired.
      (7)    An estimate of the anticipated attendance.
      (8)    The hour when such activity will start and terminate.
 
   (b)    The Board of Park Trustees shall approve and the Clerk shall issue such permit if the Board finds the following:
      (1)    The proposed activity or use of the park will not unusually interfere with or detract from the general public enjoyment of the park.
      (2)    The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation.
      (3)    The facilities desired have not been reserved for other use on the day and hour required in the application.
      (4)    The conduct of such activity will not substantially interrupt the safe and orderly movement of traffic.
      (5)    The conduct of such activity will not cause the diversion of the police officers of the Municipality from providing other normal police protection to the Municipality.
      (6)    The conduct of such activity is not reasonably likely to cause injury to persons or property, incite violence, crime or disorderly conduct.
      (7)    Such activity is not to be held for the sole purpose of advertising a product, goods or event, and is not designed to be held purely for profit.
      (8)    That the permit fee of five dollars ($5.00) has been paid.
      (9)    That such activity will not violate any of the ordinances of the Municipality.
 
   (c)    The Board of Park Trustees shall have the authority to impose as a condition to issuance of any such permit such special conditions as the Board deems necessary or desirable to protect Municipal property and to insure compliance with its rules and regulations. Such conditions may include requiring such security deposits as the Board deems necessary and requiring the applicant to furnish such additional police protection as the needs of the event may require.
 
   (d)    The permit shall be in the form as prescribed by the Clerk and shall state thereon the following:
      (1)    The name, address and telephone number of the person to whom the permit is issued and who is in charge and responsible for the assembly.
      (2)    The name, address and telephone number of the organization sponsoring the event.
      (3)    The facility and area limits where the assembly is authorized.
      (4)    The date and time limit thereof.
      (5)    The purpose and activities permitted.
      (6)    The number of persons permitted in attendance.
      (7)    The special conditions imposed.
      (8)    The fee paid.
 
   (e)    The Board of Park Trustees shall act upon the application for a park permit at its next regular scheduled meeting after the filing of the application therefor. In the event that the Board of Park Trustees fails to approve the permit at its next regular meeting, the applicant may appeal the matter to Council. The appeal must be in writing and filed with the Clerk within ten calendar days after the Board of Park Trustees meeting.
 
   (f)    Any permit approved and issued may be revoked by the Board of Park Trustees, Council or by order of the Mayor. Any revocation other than by Council may be appealed to Council in the same manner as provided in the case of failure to approve the permit.
