(a) Any owner or occupant who wishes to give notice that any acts described above in Section 731.02 and 731.06 are prohibited on his property may do so by delivering to the City a signed request that his property be listed as prohibited for such acts.
(b) The City Manager shall maintain a do-not-solicit list as identified in Section 731.08(a). That list shall be available for inspections in the Office of the City Manager during business hours from 8:00 a.m. to 4:30 p.m. Copies of the list shall be provided upon request at the City of Union Municipal Building. The City Manager shall provide a copy of the do-not- solicit list to each person issued a license pursuant to Section 731.03. Properties may be removed from the list in the same manner that they are added to it.
(c) Every person who elects to add his or her property to the do-not-solicit list shall be required to re-register every five years. Any property that is not re-registered in accordance with this section shall be removed from the do-not-solicit list.
(d) The City Manager on a periodic basis shall compare the do-not-solicit list to the utility database to identify which properties have been transferred or sold since being registered. The City Manager shall remove any such properties from the do-not-solicit list if a change has been made and the City Manager has not been notified by the new owner or occupant therein.
(e) No person shall perform any acts regulated by Chapter 731 without first inspecting the do-not-solicit list referred in this section. The inclusion of property on that do-not-solicit list shall constitute constructive notice to all persons that such actions are not permitted on that property. (Ord. 1541. Passed 7-9-12.)
