Nothing is this chapter shall be construed to prevent any person from maintaining any pipe or conduit in any public street, alley or public place, or from making such excavations as may be necessary for the preservation of life or property when necessity arises; provided, however, that he shall assume all cost and liability in connection with the work. When an emergency excavation has been commenced, the person making such excavation shall secure a permit therefor on the next working day.
