8-1-7: CERTIFICATE OF OCCUPANCY:
No person shall occupy or use any building or structure or portion thereof until the building official has issued a certificate of occupancy. No building or structure shall have its existing occupancy classification until the building official has issued a certificate of occupancy for the new use. A certificate of occupancy shall not be issued until all relevant requirements of this code are met, including, but not limited to, this chapter, title 10 and subsection 7-2B-2C of this code. However, the city administrator may direct the building official to issue a temporary certificate of occupancy and may temporarily allow use of water and sewer before the installation and completion of these requirements provided the owner and developer, if any, have posted a performance bond with the city in an amount satisfactory to the city administrator to ensure the completion of these requirements within a specified time satisfactory to the city administrator.
