7-7-12: HAZARD TREES:
   A.   The city shall remove or order to be removed any tree within a public right of way that constitutes a risk to public safety or property.
   B.   The city shall remove or order to be removed any tree on private property that constitutes a risk to public safety or property within the public right of way. This may include, but not be limited to, dead, damaged, or diseased trees.
   C.   The city shall have the right to cause the remedial treatment, if appropriate, of diseased trees on public right of way or private property within the city when the trees harbor insects or disease which constitutes a potential threat to other trees within the city.
   D.   The city's tree board will notify the owner of the trees in writing and will order the removal or remedial treatment. Failure of the property owner to comply with the order of the city's tree board after thirty (30) days' notice shall be deemed a violation of this section and the city may then remove, trim or cause remedial treatment of the trees or shrubs at an assessed cost against the property.
