913.02  DRIVEWAYS.
   (a)   Private driveways shall be limited to one such driveway per residence on any one street.  The width of the break in the curbing for each such driveway shall not exceed twenty feet.
   (b)   The slope necessary from the street level to any driveway, whether private or otherwise, shall consume only that distance represented by the curb or lawn strip between the outside curb line and the regular outside line of the sidewalks where possible and in no case shall interfere with the level or grade of the sidewalk for a distance less than four feet from the inside line of such sidewalk.
   (c)   Permission to break any curbing now existing or any constructed in the future shall be requested of the Director of Public Service and bond shall be deposited with the Service Director or his agent, in the amount of five dollars ($5.00) per lineal foot representing the width of the break in the curbing.  Such bond shall be refunded when the construction is completed to the satisfaction of the Director of Public Service.
   (d)   The cost of any driveway, whether private or commercial, including the rounding of the curb into same and the replacing of any part of the sidewalks or street in their original condition, shall be paid by persons constructing or benefitting from the construction of same.
   (e)   The location of existing sewers or sewer drops shall not be changed, or the levels or grades of sidewalks or streets changed without the permission of the Director of Public Service, on the advice of the City Engineer.
   (f)   The width of any driveway to be used for commercial purposes shall not exceed thirty feet and in no case shall any driveway be located less than twenty-four feet from the near sidewalk line at right angles to the street, on a corner location.  Council shall have the authority to grant variances to this subsection when specific requests are made and they deem such request to be in the best interests of the City.
   (g)   When any such new construction is anticipated for the purpose of constructing a private drive or commercial drive a concrete apron approach shall be costructed in connection with the same. 
   A performance bond shall be posted by an individual or contractor with the Director of Public Service for breaking through of sidewalks, or any sidewalk constructed in the future, in the amount of fifty dollars ($50.00) per foot.  Such bond shall be refunded when construction is completed and the break is repaired in a manner approved by Director of Public Service.
