909.01 PERFORMANCE BOND.
   (a)   A performance bond shall be posted by an individual or contractor with the Director of Public Service for breaking through of paved streets, sidewalks, alleys and underground chambers as follows:
      (1)   Inside curb line: One dollar and twenty-five cents ($1.25) per square foot with a minimum bond of twenty dollars ($20.00).
      (2)   Outside curb line: Three dollars ($3.00) per square foot with a minimum bond of fifty dollars ($50.00).
   Such bond shall be refunded when construction is completed and the break repaired in a manner approved by Director of Public Service.
   (b)   Whoever violates the posting of such bond or fails to restore such excavation in accordance to ordinances governing the same shall be required to pay any and all damages caused by such violation or neglect.
   (c)   A performance bond for breaking any existing curb or any curb constructed in the future shall be deposited with the Director of Public Service or his agent in the amount of five dollars ($5.00) per lineal foot representing the width of the break in the curbing. Such bond shall be refunded when construction is completed and approved by the Director of Public Service.
   (d)   No bond requirements set forth herein shall apply to the Twin City Water and Sewer Department, East Ohio Gas Company, Ohio Power Company, Ohio Bell Telephone Company or their successors. However, the City reserves the right to recover any injuries in the normal course of civil law.
