505.16  PROHIBITING THE KEEPING OR HARBORING OF PIEGEONS.
   (a)   Council for the City of Uhrichsville declares the keeping or harboring of pigeons to be a public nuisance. No person who is the owner or occupant of any real property within the City shall keep or harbor any pigeons on real property within the City.
   (b)   No person shall erect, use, continue to use, or maintain any building, structure, or place for the keeping or harboring of pigeons.
   (c)   "Keeping" is defined as allowing pigeons to remain on the real property in cages, coops or any other form of shelter.
   (d)   "Harboring" is defined to include the housing of pigeons, feeding or providing any necessary sustenance to pigeons, or failure of a property owner or occupant to maintain structures and building in such a manner that would exclude the entrance by pigeons into the structures and buildings.
   (e)   Whoever violates this provision shall be guilty of a minor misdemeanor on a first offense and subject to a fine not exceeding one hundred fifty dollars ($150.00). Each day that the offense continues shall constitute a separate offense. If the offender previously has been convicted of or plead guilty to this offense, whoever violates this section shall be guilty of a misdemeanor of the fourth degree.  (Ord. 24-20.  Passed 7-23-20.)
