905.03  SIGNS ON CITY SIDEWALKS.
   (a)   Definitions.
      (1)   “A-frame” means a sandwich board style sign that has two sides, the frame or support structure of which is hinged or connected at the top in such a manner that the sign is easily moved or erected.
      (2)   “T-frame sign” means a sign that is supported by posts or other supports that are not attached to the ground, or any building or structure, and can stand on its own and is weighted at the bottom.
      (3)   “Sidewalk sign” means an A-frame sign or a T-frame, or other temporary self-supporting type sign, placed on the public sidewalk.
      (4)   “Service Director” means the Director of City Services of the City of Uhrichsville, or his/her designee.
      (5)   “Police Department” means the department of law enforcement of the City of Uhrichsville.
   (b)   Operational Conditions.
      (1)   A sidewalk sign may be placed on the sidewalk in front of a licensed business located in the territorial limits of the City of Uhrichsville, and shall comply with all aspects of this section upon approval.
      (2)   Only one sign may be allowed per street address.  A business shall only be allowed one sign per business location.
      (3)   A sidewalk sign shall not be placed in a street or an alley and shall not be placed on a vehicle.
      (4)   A sidewalk sign shall not be placed near an intersection, crosswalk ramp, driveway or alley.
      (5)   A sidewalk sign shall not be bolted, chained, tied, or otherwise affixed to the sidewalk or public thoroughfare or any object thereon.
      (6)   A sidewalk sign may be displayed only during hours of normal business operations.  The sidewalk sign shall be removed during closed business hours.
      (7)   A sidewalk sign shall not be displayed during hazardous weather condition, including, but not limited to heavy wind, heavy rain, or snow conditions.
      (8)   A sidewalk sign shall be no larger than six feet in area and no greater than four and a half feet in height.
   (c)   Insurance.  Businesses displaying a sidewalk sign must be insured.
   (d)   Enforcement.  The Uhrichsville Police Department shall have authority to enforce this section and any rules promulgated thereunder.  Any sidewalk sign found to be unsafe or hazardous shall be subject to removal.
   (e)   Penalties.  Any owner, occupant, firm or corporation violating a provision of this section, upon conviction, is guilty of a minor misdemeanor.  A second violation will result in an offense punishable as provided under the Uhrichsville City Code as amended.
