1329.05  ISSUANCE OF A CERTIFICATE OF OCCUPANCY.
   (a)   No owner, operator, or agent shall rent, lease, sell or permit occupancy of any rental, dwelling, dwelling units, or part thereof which does not comply with the provisions of this chapter.
      (1)   This is not included to supersede Section 1149.02, "Certificate of Occupancy".
      (2)   A Certificate of Occupancy must be issued before a rental dwelling unit can be sold.
      (3)   All rental dwellings shall be inspected and issued a Certificate of Occupancy by Jan. 1, 1991.
      (4)   Any rental property sold or transferred after July 1, 1990 should be inspected.
   (b)   Everytime there is a change in occupancy of the unit or units there shall be a new Certificate of Occupancy issued.
   (c)   (1)   Each and every time a unit or units become unoccupied, a written notice shall be given at the Mayor's Office of the City stating the fact that the unit or units are unoccupied.  Such notice of unoccupancy shall include the following information:
         A.   Date of filing the notice;
         B.   Address or addresses of the unit or units;
         C.   Signature of owner, operator, or designated representative;
         D.   The name and address of the owner, agent, operator, or person in charge;
         E.   The exact nature and extent of the use or occupancy authorized;
         F.   Permission to inspect the property.
      (2)   Three copies of this notice shall be filed with the following:
         A.   Mayor's Office;
         B.   The owner or operator;
         C.   The City's Building Inspector.
      (3)   When the Notice of Unoccupancy is filed, inspection of the unit or units shall be made within five days, excluding weekends and holidays.
   (d)   The owner of a dwelling structure which will be completed and available for rental occupancy subsequent to January 1, of any year shall apply for a Certificate of Occupancy as soon as possible, but in no event shall such structure be occupied in part or whole until such Certificate of Occupancy has been issued.
 
   (e)   When minor violations exist a Provisional Certificate of Occupancy may be issued subject to correction of the minor violations, within a reasonable period of time.
