901.01 PERMIT REQUIRED; FEE.
   No person other than a duly authorized officer or employee of the Municipality shall make an excavation in any street, alley, sidewalk, curb, curb cut, driveway or street on the public right of way without first obtaining proper approval.
   (a)   Public Contracts: The Engineering Department coordinates, designs, causes to be advertise and bid, recommends award by Council improvements to City Streets. These contracts require performance and maintenance bonds and insurance to be provided by the Contractor. A signed contract or purchase order is equivalent to a permit.
   (b)   Developments: Major Subdivisions and the construction of infrastructure associated to the subdivision are required to enter into a Construction Agreement and associated bonding with the City of Twinsburg. Council authorizes the Mayor to enter into said agreement and a signed agreement is equivalent to a permit to proceed. Inspection charges will be billed to the developer.
   (c)   Right of Way Permits; Fee. All other work within the City right of ways must first obtain a permit in writing from the Building Commissioner and pay those fees set forth in Section 1323.05 of the Building Code. The right of way permit covers the cost of inspection.
