4-2-4: PENALTIES FOR VIOLATION:
   A.   Action: For a violation of this chapter the county may pursue any one or more of the following actions:
      1.   See voluntary compliance;
      2.   Issue a civil citation (infraction);
      3.   Pursue a civil action to enforce compliance with the terms of this chapter or to enjoin, restrain or abate any violation of the terms of this chapter; or to seek any other appropriate remedy;
      4.   Pursue criminal prosecution.
   B.   General Penalties: Violations of this chapter are punishable as follows:
      1.   For a first violation the violator will be deemed guilty of an infraction and shall pay the fixed penalty of fifty dollars ($50.00).
      2.   For a second violation within two (2) years, the violator will be deemed guilty of a second offense infraction and shall pay the fixed penalty of one hundred dollars ($100.00), notwithstanding that the solid waste involved may or may not be the same solid waste as was involved in the previous violation.
      3.   For a third violation within two (2) years, the violator will be deemed guilty of a misdemeanor and may be fined up to one thousand dollars ($1,000.00) and may be jailed for up to six (6) months, notwithstanding that the solid waste involved may or may not be the same solid waste as was involved in the previous violation.
      4.   Each day of continuing violation may be assessed as a separate violation. (Ord. 223, 11-4-2011)
