4-2-3: SOLID WASTE DISPOSAL; DELIVERY:
   A.   Delivery Of Solid Waste To District's Sites: From and after November 1, 2002, all solid waste collected from any source or location within Twin Falls County, Idaho, whether collected by the county, any incorporated city, or by any commercial collector of solid waste, shall be delivered to the approved transfer station(s) or other solid waste disposal or resource recovery site(s) within or designated for the use of the county by the Southern Idaho regional solid waste disposal district or its successors or assigns.
   B.   Deposit Of Solid Waste: Deposit of solid waste is permitted at official disposal sites only.
      1.   Dumping Prohibited: No person shall throw, discard, or deposit any solid waste or refuse in or upon premises, improved or vacant, either public or private, unless said premises is an official disposal site. No person shall throw, discard, or deposit any solid waste upon any roadway, street, alley, sidewalk or vacant ground, or in or upon any canal, irrigation ditch, drainage ditch or other watercourse.
      2.   Accumulation Prohibited: All persons shall maintain their property or premises in a sanitary condition, free from solid wastes. No person or persons, business, corporation, or other entity (except for authorized or designated sites which comply with all federal, state and local laws) shall allow solid wastes or refuse to be maintained on any premises, lot or property under his or her ownership or control. Solid waste may be stored for no more than fourteen (14) days pending transport to a designated disposal site.
      3.   Deposit On Another's Property Prohibited: It shall be a violation of this chapter to deposit solid waste on the property of another or to allow solid waste to accumulate on a person's or entity's own property.
   C.   Recyclable Materials: Recyclable materials shall be stored, handled and disposed of only at authorized or designated sites which comply with all federal, state and local laws. Recyclable materials may be stored by individuals, businesses, corporations, or other entities pending transport to a recycling center, recycling plant or designated site for no more than one hundred eighty (180) days. The transport and delivery of recyclable materials shall be in compliance with all federal, state and local laws. Recyclable materials shall be considered solid waste for purposes of this chapter if the materials are not taken to a recycling center or recycling plant within one hundred eighty (180) days.
   D.   Private Composting: Private composting is allowed. Compostable materials are not required to be taken to disposal sites, provided that the materials are currently being composted and the composting is in compliance with all other applicable laws and regulations. Commercial and agricultural composting is allowed subject to zoning restrictions and all other applicable laws and regulations.
   E.   Solid Waste Transportation: No person shall cause or permit a vehicle used to haul or transport solid waste to be so loaded, or to be of such construction or condition, so as to permit any of the solid waste to drop or fall upon or in any street or public way. (Ord. 223, 11-4-2011)
