3-3-4: LEASE REQUIREMENTS:
In the case of ongoing services such as boat tours, balloon rides and refreshments, the required license may take the form of a lease.
   A.   Any such lease granted hereunder for proprietors any enterprise shall be limited to one concessionaire per lease unless otherwise declared in writing by the board.
   B.   Any such lease applicant must submit the appropriate rental payment, as set by the board. Failure to pay any fee within thirty (30) days of the date due is a violation of this chapter, and will be considered grounds for termination of the lease. Any rental payment will be utilized by the Twin Falls County parks department for maintenance of the county parks.
   C.   The maximum period for any lease granted hereunder will be given five (5) years.
   D.   Before issuing a lease for ongoing services, the board should consider:
      1.   Whether public demand exceeds present services;
      2.   Whether an applicant holds necessary license from other agencies;
      3.   Proof of liability insurance in the amount of one million dollars ($1,000,000.00) for concessionaires with Twin Falls County named as an insured; or proof of liability insurance for all other permittees;
      4.   South Central health department written approval;
      5.   Twin Falls County sheriff's department written approval for marine activities. (Ord. 125, 7-10-2000)
