6-1-2: WATER ON PUBLIC HIGHWAYS:
   A.   Water User Defined: A user of water is one who controls, manages, directs, diverts, uses, or implements water, water ditches or water pumps, whether or not the water comes from a water district or irrigation district, so long as the water, water ditches, or water pumps pertain to the land from which the water flows, runs or sprinkles onto a public road.
   B.   Permissive Inference: A permissive inference can be made that either the landowner, or occupant of land, or a user of water, or a provider of water is responsible for and has the ability to prevent the flow of water upon a public road. (Ord. 117, 4-27-1992)
   C.   Penalty: Any person violating any of the provisions of this Section shall be subject to penalty as provided in Section 1-4-1 of this Code. (1996 Code)
