5-7-5: REGULATIONS NEAR HYDROELECTRIC PROJECTS:
   A.   Purpose: To promote and protect the safety and welfare of the public immediately above and below hydroelectric projects located on the Snake River due to the inherent dangers associated with such projects, as authorized by title 31, chapter 7, section 14 of the Idaho Code.
   B.   Definition: "Access" includes access of any type, including, but not limited to, boating, kayaking, fishing, swimming, hunting, picture taking, or any other activities.
   C.   Prohibited Acts: It shall be unlawful for any person, other than law enforcement or employees of Idaho Power Company, or their agents, to access the Snake River below the high water mark:
      1.   At Bliss power plant between the downstream side of Idaho Power Company's dam, spillway and powerhouse, and Idaho Power Company's upstream buoy line.
      2.   At Lower Salmon Falls power plant between the downstream side of Idaho Power Company's dam, spillway and powerhouse and Idaho Power Company's upstream buoy line.
      3.   At Upper Salmon Falls power plant between the downstream side of Idaho Power Company's dam, spillway and powerhouse and Idaho Power Company's upstream buoy line, including, but not limited to, the power canal.
      4.   At Shoshone Falls between the base of Shoshone Falls and Idaho Power Company's upstream buoy line.
      5.   At Twin Falls power plant between the downstream side of Idaho Power Company's dam, spillway and powerhouse, and Idaho Power Company's upstream buoy line.
      6.   At Milner power plant between the downstream side of Milner Dam Incorporated's dam, spillway and Idaho Power Company's powerhouse, and Milner Dam Incorporated's upstream buoy lines.
      7.   At the above facilities, other areas designated by signage as restricted due to inherent public safety dangers.
   D.   Violation: Any violation of this section is declared to be a misdemeanor and shall be punishable in accordance with the general misdemeanor penalties set forth in the Idaho Code.
   E.   Search And Rescue Expenses: In the event that it becomes necessary to provide search, rescue, or retrieval services for a person or persons who violate(s) this chapter, the county reserves the right to assess and recover expenses from the violator(s). (Ord. 211, 11-3-2008)
