§ 111.41 CATERER'S PERMIT.
   A Caterer's permit shall allow the sale of alcoholic liquor by a caterer or current holder of another type of liquor license provided for in this chapter, in connection with the sale of prepared food, for service at private parties, weddings, or other similar private events which are not open to the general public, at a location other than the premises leased, owned or otherwise operated by the licensee. For the purpose of the application of the regulations of this chapter, the location of the catered event shall be deemed the licensed premises. In addition to compliance with other requirements for licensed premises in this chapter, a caterer's permit shall be subject to the following requirements:
   (A)   The Mayor, with the advice and consent of the Local Liquor Advisory Committee, may prescribe the application format and issue caterer's permits in accordance with this chapter.
   (B)   A caterer's permit licensee shall be a bona fide caterer or current holder of another type of liquor license provided for in this chapter.
   (C)   Consumption of alcoholic liquor shall only be permitted on the premises where the food is catered.
   (D)   The applicant for the caterer's permit shall present proof of host liquor liability insurance before the permit is issued, and, further, shall present proof of a license from the state authorizing the sale and consumption of alcoholic liquor prior to the permitted event.
   (E)   The recipient of the caterer's permit shall be responsible for compliance with Tuscola's Alcoholic Beverages Code of Ordinances, in all respects, and shall comply with state law as found in Illinois Compiled Statutes concerning the sale, delivery and consumption of alcoholic beverages including, but not necessarily limited to, the prohibition upon the sale of alcoholic liquor to any person under the age of 21 years, and the prohibition of the sale or delivery of alcoholic beverage to any intoxicated person or person under legal disability or in need of mental treatment.
   (F)   A caterer's permit is not meant to replace a festival permit, and nothing in this section shall excuse an applicant or licensee from the requirements of § 111.40.
   (G)   In the event that the caterer's permit licensee has entered into a contract with another individual or entity for the service of food at the catered event, a copy of the contract shall be available for inspection on the premises of the catered event, during the event.
   (H)   No event catered by a caterer's permit licensee shall exceed three days in length, nor shall alcoholic liquor be served at such an event for more than eight consecutive hours.
   (I)   The fee for a caterer's permit shall be $50 payable to the city prior to the event.
