§ 93.02 ABATEMENT.
   (A)   It is made the duty of the Board of Health to serve through the Chief of Police or other person designated by it, a notice in writing upon the owner, agent, occupant, or person in possession, charge, or control of any lot, building, or premises in or upon which any nuisance may be found. This notice shall require him to abate the nuisance within a specified time in such manner as the Board shall prescribe; provided, it shall not be necessary in any case to specify in this notice the manner in which the offense shall be abated unless the Board of Health deems it advisable to do so.
   (B)   If the person so notified refuses or neglects to comply with the order within the time and in the manner specified, the Board of Health, by the Chief of Police or other police officer of the city, shall cause the abatement of the nuisance at the expense of the party or parties responsible for or permitting the same.
   (C)   In the instance of a nuisance resulting from fire or smoke as defined in § 93.01(K), any person, persons, or entity notified of the nuisance by the Fire Chief, Police Chief, or officer or designee of the Fire Chief, Police Chief, Tuscola Fire Department, or Tuscola Police Department shall immediately extinguish or eliminate the fire or source of the smoke. If the person so notified refuses or neglects to comply with the order within a reasonable time, then the responsible party shall upon conviction be subject to the penalty provided in § 93.99. Notwithstanding the foregoing, the Fire Chief, Police Chief, or officer or designee of the Fire Chief, Police Chief, Tuscola Fire Department, or Tuscola Police Department shall have the authority to extinguish or eliminate the fire or source of smoke to protect life, property, and the public safety.
