§ 31.05 COMMISSION; DELIVERY OF OFFICE TO SUCCESSOR.
   All officers, elected or appointed, except the Clerk, Aldermen, and Mayor, shall be commissioned by warrant, under the corporate seal, signed by the Clerk and Mayor, or presiding officer of the City Council. Whenever a person has been elected or appointed to office, the Mayor shall issue a certificate of appointment or election, under the seal of the city, to the Clerk. Any person who has been an officer of the city shall, within five days after notification and request, deliver to his successor in office all property, books, and effects of every description in his possession, belonging to the city or appertaining to his office. Upon his refusal so to do, he shall be liable for all damages caused thereby, and shall be subject to a penalty of not less than $25 and not exceeding the general penalty provided in § 10.99
