(A) Permitted. Residential accessory structures, unless otherwise regulated by this chapter, shall be permitted in the single-family and multiple-family residential districts.
(B) Development standards.
(1) Height: the height standard of the zone district in which the accessory structure is located, unless otherwise stipulated for in this chapter.
(2) Setback: the following are setback standards for residential accessory structures, unless otherwise provided for in this chapter.
(a) Front yard setback: same as front yard setback for the district in which the accessory structure is being placed, except in the case of uncovered patios, decks and porches. These structures may encroach in to the required front yard by five feet.
(b) Rear yard setback: accessory structures may be located within three feet of the rear property line.
(c) Side yard setback: accessory structures may be located within three feet of the rear property line.
(d) Side yard, street side setback: accessory structures may be located within ten feet of any street side yard property line.
(e) Kitchen may be located within a residential accessory structure subject to the granting of an administrative approval and securing of a building permit.
(f) All accessory structures shall be constructed concurrent or subsequent to, the construction of the principal structure or activation of the principal use. Any construction of an accessory structure prior to construction of a principal structure, or activation of a principal use is prohibited, unless an administrative approval has been granted.
(g) A bathroom may be located within a residential accessory structure subject to securing a building permit.
